RESOLVED, that the Town of Greenwich accept a three year grant for $60,000 from the State Education Resource Center (SERC).  Said amount is and to be hereby appropriated to the following account E0458 43100.

EXPLANATORY COMMENTS
The State Education Resource Center (SERC) has awarded the District a total of $60,000 over three years with the expectation that the funds will assist the district in its implementation of effective Early Intervening Services.

The goal of this initiative is to use consistent pre-referral strategies for at risk students across all 15 schools. Grant funds will support the development and production of parent brochures and web pages, ongoing professional development, and the development of a “Help Line” where parents, teachers or students can receive strategies or suggestions on a variety of topics. The grant award letter stated, “The work of the Greenwich Public Schools should be commended as Connecticut strives to build a continuum of supports and interventions for all students, through the development of district partnerships across Connecticut.”

ITEM NO.               3
DEPARTMENT:     Petition – twenty registered voters

REFERRED TO:      Legislative & Rules and Town Services Committees
VOTES:

WHEREAS, The citizens of the Town of Greenwich (the "Town") have the right to know when public meetings and hearings are held, their location, and a detailed agenda for said meetings; and

WHEREAS, The Representative Town Meeting (the "RTM") of the Town in its responsibility as the representatives of the electorate of the Town needs to be apprised of all activities of Town departments, boards, commissions, councils, and committees, including all school building committees and building project committees.

NOW, THEREFORE, BE IT RESOLVED, that the following Public Notification Ordinance be enacted by the Representative Town Meeting.

PUBLIC NOTIFICATION OF MEETINGS AND HEARINGS

(a)     The Town's Building Construction and Maintenance Department and the Town Clerk's Office together shall provide and maintain a publicly viewable display case in the lobby of the Town Hall for the posting of all upcoming meeting notices and agendas in accordance with §7-3 of the Connecticut General Statutes.

(b)     All Town departments, boards, commissions, councils, and  committees, including all school building committees and building project committees, will provide meeting notices and agendas in accordance with §1-225(c) and (d) of the Connecticut General Statutes and these notices shall be posted in the publicly viewable display case set forth in (a).

(c)     All updates, modifications, and changes to meeting notices or agendas posted in accordance with (b) shall be made available within one hour.

(d)     The Town's Information Technology Department shall institute and maintain a single page on the Town's web site that consists of a listing of the public notices and agendas as set forth in (b) with links to electronic versions of the notices and agendas. The implementation of these notices and agendas shall:

(e)     Use a read only, portable document format that is available at no expense across all computing platforms; and

(f)     Be electronically syndicated using an open, standard electronic syndication format for dissemination to any interested party; and

(g)     Allow an interested party to subscribe to these notices and agendas, and receive the notices and agendas via electronic mail; and

(h)     Be updated in accordance with (c); and

(i)     Have the formats described in (d)(1) and (d)(2) approved by the Representative Town Meeting or a Special Committee of the Representative Town Meeting.

(j)     All the Town's local government access television channels provide the information set forth in (d)(2) during scheduled times in the course of its broadcast day.

(k)     This section shall take effect sixty days after enactment.

EXPLANATORY NOTES:

(a)
Currently, the meeting notices for Town meetings are spread across several bulletin boards throughout the Town Hall building. This makes it very hard for a citizen to determine which meetings are upcoming, the agendas, and the locations for those meetings. By providing a single area to display all of the meeting notices, the citizens will be able to see the notices from all the departments without having to go to each individual department.

By placing the display case in the lobby of the Town Hall, the notices will be available to the citizens whenever the building is open. From a practical point of view, the various offices of the departments typically close between 4:00pm and 4:30pm. This makes accessing public meeting notices problematic for anyone who works a regular job, and even worse for those who commute.

(b)
The Connecticut General Statutes are clear concerning what information needs to be provided on a public meeting notice. This paragraph is merely to reaffirm what constitutes a public meeting notice and the requirement of having a complete, detailed agenda.

(c)
Even with having the meeting notices posted in the lobby of Town Hall, there are situations where changes and updates to notices will not be available to the public in a timely manner. The statutes specify twenty-four hour prior notice. However, from a practical point of view, twenty-four hour notice typically means that the changes would not be published in the print media nor readily available without examining the notice board. By providing these notices in electronic form quickly, the citizens have another accurate, updated method of
verifying meeting times and places.

(d)
Having a single location on the Town's web site that lists all the upcoming public meetings and hearings, a citizen does not have contact or visit the Clerk's office or, in some cases, the office of an individual department.

The use of electronic syndication, typically RSS (Really Simple Syndication), allows a citizen to monitor the notices for changes, and be instantly notified.  Most web based news headlines are provided in this form. There  are many ways to electronically access the electronic syndication, and the citizens can choose from many different tools and software to
do so. In addition, by having an RSS electronic feed, channel 79 can have up-to-date meeting information broadcast over the local government access channel.

This paragraph attempts to affirm that changes to meeting notices, such as a location change, are covered under the statutes and require the same level of notification that the original meeting did. By having the changes available electronically when the change is made, the public has a better opportunity to attend the meeting or see what on the agenda has changed.

(e)
This paragraph also affirms that another method of providing information to the citizens will be maintained. As channel 79 is granted to the Town for government access, it is appropriate that the channel be used to provide updated meeting information to the public.

RESOLVED, that the Town of Greenwich accept a gift of a formal park entrance walkway valued at $7,500.00 from the McNamee Family to be located at Roger Sherman Baldwin Park, South Arch Street, Greenwich, Connecticut.

EXPLANATORY COMMENTS

Explanation by the Director of Parks and Recreation:

An improvement to Roger Sherman Baldwin Park has been proposed by Brian McNamee’s widow Betsy as a gift to the Town.  Roger Sherman Baldwin Park currently has no formal entrance into the park.  Many events are held at the park and a formal entrance would enhance the park as well as serve as a control point for park events.  Currently event patrons enter the park over a grassy area that often reverts to bare soil and mud due to the foot traffic.

The gift of Brian’s path would consist of a six-foot wide walkway of dry laid pavers that would extend 35 feet into the park.  At the terminus of the walkway there would be circular area of pavers, eight feet in radius.  In the circular area there would be a three-foot radius central medallion of inlaid bluestone.  The circular area will also be accented with four planters.

EXPLANATORY COMMENTS
This code change was referred to the RTM Legislative and Rules Committee for review.  The Committee met on July 30, 2007 with Conservation and Law Department staff in attendance and is submitting this revised language to the RTM.  This code change updates language relating to the management of fish and wildlife on Town properties.   It reflects actual practice including management, monitoring, research, and educational activities that have been ongoing.  It also reconciles with other sections of the Charter and Code that call for proper maintenance of properties and protection of the public from nuisances.  The original call item was unanimously approved by Board of Selectmen at it’s Feb 14, 2007 meeting.  RTM L&R now recommends the revised language as presented.

Additions are in bold, deletions in [brackets]

EXPLANATORY COMMENTS

The procedures for the sale of land and the purchase, acquisition and lease of realty have never been addressed in the Greenwich Code of Ordinances.  It has been past practice for the First Selectman, upon approval of the Board of Selectmen, to recommend to the RTM action on the sale, purchase, acquisition or lease of property.

An existing exclusion to this procedure is the sale of real estate obtained in a tax foreclosure - the Greenwich Code of Ordinances Article 8, Section 2-35 - requires BET and First Selectman approval of such a sale.  The purpose of the proposed amendment is to include the BET and the RTM approval processes with respect to the sale, purchase, acquisition and lease of realty in the Town of Greenwich.

The amendment would conform the sale, purchase, acquisition and lease of realty to the Town of Greenwich Charter, Article 1., Sec.1. which requires that “The Board of Estimate and Taxation shall be responsible for the proper administration of the financial affairs of the Town…” and also Article 9., Section 99. of the Town of Greenwich Charter requiring municipal improvement for the acquisition, sale or lease of public real property.

RESOLVED, that the sum of $250,000 be and the same is hereby appropriated to be added to Capital Account Number Z312-59660-28xxx, known as “Drainage Study, Pemberwick”.
EXPLANATORY COMMENTS

This request is for interim funding in the amount of $250,000 to accelerate the execution of several drainage studies. As a result of March and April 2007 storms serious flooding occurred in several areas of Town.  These studies are being conducted as elements of a Town-wide drainage master plan.  These study areas have been selected given the significant impacts experienced during recent weather events.  Work planned under these studies includes:

Byram River and Strickland Brook Flood Studies:  The goals of these studies is to develop hydrologic and hydraulic models specific to these watersheds (Byram is 29 square miles; Strickland encompasses 2.5 square miles), based on up to date Town zoning and development and watershed specific cross sections of the flood plain.  A portion of the Byram watershed will include the work required to evaluate the adequacy of the Bailiwick Road Bridge structure.

Using these tools, new flood mitigation recommendations and an analysis of flood plain restrictions will be presented.  Modeling analysis will include as assessment of current flooding problems and an alternatives analysis of potential improvements. Simulations will be run to evaluate the effects of various improvements.

For recommended improvements, the studies will address permitting requirements, provide planning level cost estimates, and identify related issues pertinent to implementing such recommendations (e.g. easements necessary etc.).

Pemberwick Park Area:  A more detailed survey and evaluation of the Pemberwick Park area to evaluate the area’s drainage conveyance capacity and identify factors, which may have impacted its performance during the March 2, 2007 storm.  The study will include modeling and recommendations for any necessary system improvements including conceptual design and cost estimates.  This work will tie in with the Byram River Flood study.

A portion of this work will be supportive of the repairs involved with facilities damaged by the storms.  Those portions may be reimbursable by FEMA.

It is the intent of Public Works to combine this work with other drainage studies to complete a Storm Drain Master Plan for the Town.  Development of the plan will be reviewed with the Flood and Erosion Control Committee as it is developed.  The final results of the work will be a long-term capital plan for drainage.

These efforts will also be supportive of our efforts to comply with the Federal mandates related to the Phase II Storm Water Quality Program.  The program will build on the recently completed Storm Drain inventory.

Resolved that the Board of Selectmen is hereby authorized to seek removal of the Town of Greenwich from the Southwest Connecticut Regional Recycling Operating Committee (SWEROC) upon its determination that suitable alternatives exist to dispose of the Town’s recyclable materials at a more favorable cost than that offered by SWEROC.

EXPLANATORY COMMENTS BY THE COMMISSIONER OF PUBLIC WORKS

In 1989 the Town joined with eighteen other cities and towns to form the Southwest Connecticut Regional Recycling Operating Committee (SWEROC) for the purpose of developing facilities and organizational structures to facilitate the disposal of recycled waste generated by the municipalities to meet state mandates.  This body is a independent group with representatives from each of the cities and towns. At the current time the Public Works Commissioner has been appointed by the First Selectman as the voting member on the Committee. As currently established the Committee has autonomy from its governing bodies to commit SWEROC to a number of business arrangements. The establishment document also makes provisions for towns to unilaterally remove themselves from the organization if authorized by the legislative body at the end of the contract period with the operator of the recycling facility.  The RTM is the legislative body for Greenwich.

In 1991 SWEROC authorized the Connecticut Resources Recovery Authority (CRRA) to act on its behalf to construct and contract for the operation of a recycling facility known as an Intermediate Processing Center (IPC) located in the Town of Stratford. Funding for the IPC was drawn from bond sales associated with the Bridgeport Trash to Energy Plant. CRRA was also authorized to enter into contracts for the operation of the IPC. Towns under the provision of these agreements were obligated to deliver all of their recyclable materials to the IPC for sorting and marketing by the operator. Under specified conditions SWEROC members shared in the profits generated through the IPC. Profits in the past few years have approached one million dollars ($1,000,000) per year. These funds were distributed to the towns by way of reduction in tipping fees at the Bridgeport trash to energy plant.

The IPC is currently paid off and formally owned by CRRA on behalf of the member agencies. Although with extensions, the present contract with the operator of the IPC could have run until 2013, it has now been agreed that it will terminate June 30, 2009.  CRRA has solicited proposals from operators to improve and operate the IPC for the next ten (10) years. FCR, the current operator, was selected by CRRA as the successful proposer. Under the FCR proposal they will retool and operate the facility for a ten year period. At the end of that period CRRA will again own the facility. FCR has agreed to a minimum payment of approximately $22 per ton with cost sharing arrangements which could generate an additional $8.00 per ton of recyclable materials for a total of $30 per ton at the IPC. From this amount CRRA will subtract overhead and operating expenses of approximately $14 per ton. The net maximum revenue to the Town could be as high as $16 per ton to as low as $0. Added to the total recycled cost is the transportation cost to haul the material to the IPC. Greenwich currently pays $18 a ton to transport mixed paper and up to $65 a ton for cardboard and cans and bottles.

The towns must decide by September 18 whether to accept the proposal as outlined or to seek removal from SWEROC. Greenwich has retained the services of a consultant to assess the proposal and to evaluate potential alternatives to dispose of the Town’s recycled materials. At this time we have not received the complete results of that evaluation, however early indications are that more favorable options do exist that the Town should consider.

In addition to the purely business provision of the program there are a number of institutional questions that have not been answered concerning how cost and benefit sharing will be handled in the event that the IPC brings in new revenues. Going forward the Commissioner of Public Works believes the towns should accrue ownership of the facility and that ownership should be related to the contribution of recyclable materials. Greenwich disproportionately contributes materials to the facility and should receive credit for it. These and many other questions should be answered before we can know the full extent of our commitment to SWEROC.

Due to the time constraints it is not possible to have a full analysis to the RTM prior to the time that the Town must act on this item. It is therefore recommended that we seek authorization from the RTM to allow the Board of Selectmen to make the final decision on accepting the CRRA proposal or to seek removal from SWEROC.

It should be noted that under the Town’s settlement with CRRA, SWEROC and FCR concerning the prior non-delivery of recycled materials the Town is obligated until January of 2010 to take materials to the IPC. Any alternative disposal option would not begin until that obligation has been completed.
